Life Estate

Life Estate is defined as splitting a property into two separate titles, which results in a life estate and a remainder interest. Usually the parents retain a life estate and the children retain the remainder interest. Upon the death of the parents, the life interest simply disappears and the children receive full title. This does not constitute a transfer of property, and thus normally results in no taxes or probate fees.
